Giovanni Amoroso Appointed President of Italy's Constitutional Court

Amoroso assumes leadership with unanimous vote as Italy's Constitutional Court President.
Giovanni Amoroso has been elected as the new President of the Italian Constitutional Court, succeeding with a unanimous vote from the court's judges.

At 76 years of age, Amoroso hails from Mercato San Severino, a town in the province of Salerno.

His tenure as a constitutional judge began on October 26, 2017, following his election by the Court of Cassation.

Amoroso, who previously served as Vice President since December 12, 2023, will hold the presidency until November 13, 2026, at which point his nine-year term as a constitutional judge will conclude.

During his initial address following the election, Amoroso promised dedication to his new role, emphasizing adherence to the Italian Constitution, particularly Article 54, which outlines public office duties.

He stated, "The Court is a deeply collegial body," reiterating the importance of the Constitution as a guiding principle.

The new President expressed a desire for the complete assembly of the Court to be reinstated promptly.

The Italian Parliament is scheduled to convene on January 23, 2025, to address this matter.

Despite operating with eleven judges, which is compliant with the legal framework, Amoroso assured that the Court's functionality is not impaired.

The focus among journalists was partly directed towards the recent inadmissibility ruling on the referendum concerning regional autonomy.

Amoroso clarified that the legislative process must intervene to redefine the criteria for identifying the Essential Levels of Performance (LEP), a cornerstone of the autonomy law.

This follows a declaration of unconstitutionality affecting both the delegation of powers and the retention of LEP determination criteria under previous legislation.

In his early actions as President, Amoroso appointed Judges Francesco Viganò and Luca Antonini as Vice Presidents of the Constitutional Court.

He also informed Prime Minister Giorgia Meloni of his election, a ceremonious protocol observed upon such appointments.

In response, Meloni extended her well-wishes to Amoroso for his forthcoming tenure.

The election of Amoroso marks a new chapter for the Constitutional Court, as it continues its efforts in upholding the integrity and application of Italy's constitutional law.
